Agreement to Terms

By accessing and using the services of Pink Tulips Landscaping (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

Pink Tulips Landscaping provides professional landscaping services including but not limited to:

  • Landscape design and installation
  • Seasonal color installations
  • Irrigation system design, installation, and maintenance
  • Outdoor lighting installation
  • Landscape maintenance and care
  • Hardscape construction
  • Related landscaping services

Specific services, scope, pricing, and timelines will be detailed in individual service agreements or contracts.

Quotes and Estimates

  • Quotes and estimates are valid for 30 days from the date of issuance unless otherwise specified
  • Quotes are based on site conditions at the time of assessment; unforeseen conditions may result in additional costs
  • Clients must approve changes in scope or pricing before additional work is performed
  • Final pricing may vary if project specifications change

Payment Terms

  • Payment terms will be specified in individual service agreements
  • Deposits may be required before work begins
  • Final payment is due upon project completion unless other arrangements have been made
  • Late payments may incur additional fees as specified in service agreements
  • We reserve the right to suspend services for accounts with outstanding balances

Client Responsibilities

Clients agree to:

  • Provide accurate property information and access
  • Mark underground utilities, irrigation lines, and other hazards before work begins
  • Secure pets during service visits
  • Notify us of any property changes that may affect services
  • Maintain adequate access to work areas
  • Remove or protect valuable or fragile items in work areas

Scheduling and Cancellations

  • We will make reasonable efforts to maintain scheduled appointments
  • Weather conditions or unforeseen circumstances may require rescheduling
  • Clients should provide at least 48 hours notice for appointment cancellations
  • Repeated cancellations may result in service termination or rescheduling fees

Warranty and Guarantees

  • Plant warranties vary by plant type, season, and care requirements
  • Specific warranty terms will be provided in writing for applicable services
  • Warranties do not cover damage from improper care, extreme weather, pests, or vandalism
  • Warranty claims must be reported promptly
  • Materials and workmanship are guaranteed as specified in service agreements

Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is limited to the amount paid for the specific service in question
  • We are not liable for indirect, incidental, consequential, or special damages
  • We are not responsible for damage to unmarked underground utilities or undisclosed property features
  • We maintain appropriate business insurance but clients should verify their own property insurance coverage

Property Damage

  • We take reasonable care to prevent property damage during service delivery
  • Clients should report any damage within 48 hours
  • We will investigate damage claims and make appropriate remedies
  • Pre-existing conditions should be documented before work begins

Safety

  • We follow industry safety standards and best practices
  • Clients and visitors should stay clear of active work areas
  • Newly installed features may have specific safety requirements (e.g., keeping weight off new sod)
  • We reserve the right to postpone work if conditions are unsafe

Intellectual Property

  • Landscape designs remain the property of Pink Tulips Landscaping unless otherwise agreed in writing
  • Clients may not reproduce or share designs without permission
  • We may use photos of completed projects for marketing purposes unless clients object in writing

Termination

Either party may terminate ongoing service agreements with written notice as specified in the agreement. Clients remain responsible for payment of services rendered prior to termination.

Dispute Resolution

Any disputes arising from these terms or our services will be resolved through:

  1. Good faith negotiation between parties
  2. Mediation if negotiation is unsuccessful
  3. Binding arbitration or legal action as a final resort

Governing Law

Changes to Terms
